BUHARI SEEKS NATIONAL ASSEMBLY’S CONFIRMATION OF SERVICE CHIEFS

President Muhammadu Buhari has communicated the appointment of the Service Chiefs to the Nationwide Meeting and has looked for the affirmation of the stated appointment by the Senate via his letter to the Senate President dated 27th January 2021. This was achieved in furtherance of Part 18 (1) of the Armed Forces Act Cap. A.20 Legal guidelines of the Federation of Nigeria.

Opposite to fears expressed in some quarters that President Muhammadu Buhari has “bypassed” the Nationwide Meeting within the technique of appointment of the Service Chiefs and that he has no intention of looking for consideration and affirmation of their appointment, Mr. President upon nomination for appointment sought affirmation of the Senate for the appointment of Main Basic Fortunate Irabor, Main Basic Ibrahim Attahiru, Rear Admiral Awwal Gambo and Air Vice Marshal Isiaka Amao as Chief of Defence Workers, Chief of Military Workers, Chief of Naval Workers and Chief of Air Workers respectively, vide his aforementioned letter.

It’s on document that this similar process was adopted when the rapid previous Service Chiefs had been appointed. Upon announcement of the appointment of the then Service Chiefs – Main Basic Abayomi Olonisakin (Chief of Defence Workers), Main Basic Tukur Buratai (Chief of Military Workers), Rear Admiral Ibok-Efe Ibas (Chief of Naval Workers) and Air Vice Marshal Sadique Abubakar (Chief of Air Workers), Mr. President had written the eighth Senate on 14th July 2015 for affirmation. While the correspondence was learn on the ground of the Senate on 28th July 2015, consideration and affirmation of the appointments was carried out on the Committee of the Entire on 4th August 2015.

It is going to be recalled that the Nationwide Meeting will solely resume plenary periods on ninth February 2021 when hopefully Mr. President’s communication for consideration and affirmation of the nomination for appointment of the Service Chiefs could be undertaken.

Earlier than this administration, affirmation of Service Chiefs weren’t sought and obtained from the Nationwide Meeting in consonance with the provisions of Part 18 (1) of the Armed Forces Act Cap. A.20 LFN. We’re conscious that in Keyamo Vs. President & Ors, the Federal Excessive Courtroom put aside the Armed Forces Modification Order 2008 (purportedly made beneath Part 315 [2) of the Structure) on 1st July 2013 and dominated that the affirmation of the Nationwide Meeting have to be looked for the appointment of the Service Chiefs. We’re in compliance with the spirit and letters of each the statute and case legislation.

Signed:
Senator Babajide Omoworare
