ADC Chieftain Calls for Clarity on El-Rufai’s Detention
Usman Okai Austin, a prominent member of the African Democratic Congress (ADC), has urged the Independent Corrupt Practices and Other Related Offences Commission (ICPC) to take decisive action regarding former Kaduna State Governor Nasir El-Rufai. In a statement issued Saturday, Okai called on the ICPC to either file charges against El-Rufai or release him without delay.
Okai critiqued the agency’s choice to detain the former governor before completing its investigation, contrasting it with the conduct of the Department of State Services (DSS), which he praised for its adherence to judicial processes. He described the DSS’s approach as a demonstration of civility and democracy.
“The DSS’s decision to engage the courts rather than resorting to arbitrary detention reflects a commitment to the rule of law,” Okai stated. He argued that it is essential for legal matters to be resolved through fair judicial proceedings, rather than actions that may appear to place the ICPC above the law.
According to Okai, detaining an individual prior to concluding an investigation undermines democratic principles and could be viewed as illegal. He cited El-Rufai’s cooperation with the Economic and Financial Crimes Commission (EFCC), noting the former governor responded voluntarily when summoned and is therefore not a flight risk.
Okai also raised concerns about the lack of clarity surrounding El-Rufai’s custody status and the process of his transfer between agencies. “The EFCC has not clarified whether El-Rufai was officially transferred to the ICPC or if he was re-arrested after being granted administrative bail,” he remarked, adding that such ambiguity damages the integrity of the legal system.
In emphasizing the importance of due process, Okai pointed out that protecting the rights of the accused until proven guilty is a fundamental aspect of international legal standards. He cautioned anti-corruption agencies against using their power in ways that could lead to oppression.
“Detaining a suspect before an investigation is initiated is a severe violation of the right to a fair hearing,” he asserted. Okai concluded with a call for the ICPC to adhere to the standards of a civilized society, stating, “If there is a case against El-Rufai, present it in court. If not, he must be released immediately.”
