ICPC opposes fresh bail application by El-Rufai as court adjourns hearing

Kaduna Court Adjourns Bail Hearing for Former Governor El-Rufai
The Independent Corrupt Practices and Other Related Offences Commission (ICPC) has opposed a new bail application filed by former Kaduna State Governor Mallam Nasir El-Rufai. This follows an ongoing case before the Kaduna State High Court.
During a hearing on Tuesday, El-Rufai’s attorney, Ubong Akpang, informed the court about the pending bail application, highlighting its importance for the defendant’s liberty. He stated that all necessary legal documents had been filed and served, expressing readiness to proceed.
In response, ICPC counsel Ibrahim Mukhtar indicated that he had only recently received the defendant’s additional affidavit supporting the bail application and needed time to review it. The court subsequently adjourned the hearing until May 13, 2026.
This bail application comes after the court previously denied bail to El-Rufai, with Justice D.H. Khobo citing the absence of a detailed response from the defense. The ICPC’s counter-affidavit presented concerns including the possibility of flight risk due to El-Rufai’s influence and resources, allegations of obstructing lawful arrest, and risks of witness tampering.
Justice Khobo emphasized that bail is discretionary and must align with the interests of justice. The court noted that El-Rufai’s status could facilitate interference with ongoing investigations, particularly as some suspects are still at large. Key allegations in the ICPC’s counter-affidavit were deemed admitted by the court due to El-Rufai’s failure to contest them, and unsubstantiated health claims were dismissed for lack of evidence.
As a result, the court ordered that El-Rufai remain in ICPC custody until the trial begins, while also directing an expedited hearing. Despite this, the defense team has filed a new application for bail. The ICPC maintains its commitment to ensuring justice is upheld in this case and in the prosecution of corruption matters nationwide.
