Delta family court strikes out ‘fabricated’ case against three children

Family Court Dismisses Case Against Delta State Children
UGHELLI, Delta State – A Family Court in Ughelli has dismissed a case involving three minors alleged to have committed theft and conspiracy, following concerns regarding the legitimacy of the charges against them. The ruling was made on May 14.
Comrade Amrevuahwo Edariese, a former Chairman of the Committee for the Defence of Human Rights (CDHR), announced the court’s decision to our correspondent in Warri on Sunday. Edariese emphasized that the case was fabricated, noting that no formal complaint had been filed with the police, who merely alleged the children were involved in cult activities.
The three children, aged 12 and 7, were previously arraigned at a Magistrate Court in Orhuwhorhun on January 16 under charges that included conspiracy to commit a felony and theft of various items totaling approximately N215,950. The children reportedly pleaded not guilty to all counts.
During a recent court session, neither the police nor any complainants appeared, leading to the case’s transfer from the Magistrate Court to the Family Court, as per procedural requirements.
In detailing the charges, the court indicated that the alleged offenses took place in November 2025 at a store owned by Joy Oreva Egbeka. The items claimed to be stolen included instant noodles, snacks, and cash.
The Family Court has scheduled the next appearance for the involved parties on January 23, 2026.
