Senior Lawyer Warns of Potential Challenges for ADC Amid Supreme Court Appeal
A senior legal figure, Magaji Mato, SAN, has issued a caution regarding the African Democratic Congress (ADC), suggesting the party may encounter difficulties if the Supreme Court of Nigeria does not issue a ruling on a pending appeal within the next 48 hours.
Mato emphasized the importance of a timely decision, linking it to the political deadlines established by the Independent National Electoral Commission (INEC). He made his remarks during an interview on Arise Television’s Morning Show on Wednesday.
While acknowledging that the Nigerian Constitution allows the Supreme Court up to three months to deliver a ruling, Mato argued that the urgency of the case calls for a swifter judgment. He expressed concern that a delayed ruling could undermine the decision’s effectiveness and provoke political tensions, potentially disrupting the electoral process.
“If the ADC believes there is a need for a prompt decision on their unaddressed appeal, they are justified in that request,” Mato stated. “The court should recognize the urgency in light of the political climate and the deadlines from INEC. It is reasonable for parties to call for expeditious rulings.”
Mato highlighted that the implications of the case extend beyond Nigeria’s borders, noting that the international community is observing the country’s democratic processes closely. He cautioned against actions that might hinder the fair participation of political entities in upcoming elections.
He remarked, “The Constitution provides a three-month timeframe for the court’s judgment, but the nature of this case necessitates a prompt decision. A late ruling could lead to a crisis within the country.”
Mato concluded by expressing confidence that the Supreme Court justices are aware of these pressing concerns and reiterated his hope that the case would be resolved expeditiously, ideally within the next two days. Otherwise, he warned that political parties may face challenges meeting INEC’s deadlines.
